Q. What usage rights does a buyout license provide? A. First let us answer the question by providing a bit of related information, to help clarify the various issues involved. Licensing is On a Per-Project Basis - All of our licensing is on a "per-project" basis, meaning that for any one license you purchase, you can use the track in only one project. If you later decide you want to use the same track in a second, unrelated project, you must purchase a new license for the track for the new project. Client-Related Projects Require License Assignment - If you happen to be licensing a track for use in a project for one of your clients, you must assign the license to the client's name so that the client will then own the license for their use of the track. The assignment process happens when you file the Track Usage Report after making the purchase, as you download the track from your Download Zone. If you don't assign the license to your client, then their use of the track is considered an unlicensed, infringing use, hence it is very important to assign the license to them so their use of the track is legally authorized and protected. Once you assign the license to your client, then they possess the license and you no longer possess the license hence you may not use the track in one of your own internal projects without purchasing a new license for the track. What a Buyout License Provides You - So, then, when you purchase a buyout license, you receive a license for use of the track in one project, in any media, worldwide, in perpetuity (i.e. forever), within the context of the single project. The license you purchase is a non-exclusive license, meaning that you don't then own the track. Rather, it is not an exclusive license, you simply have the rights to use it as mentioned in the previous sentence. The owner of the track still owns the track and the track remains here on the site, available for license by other clients at any time. Restrictions - For any track you license here, you can't resell it, you can't put lyrics to it and sell it as your own song, and you can't integrate it into your own music composition. These types of uses are prohibited, however we do provide a limited exemption to the restriction on adding lyrics (see the details about this here). Converting From a Limited License to Buyout License - If you initially purchase a limited license and then later decide to upgrade that to a buyout license for the track, depending on how much time has passed since the original license purchase, some of your original purchase price may be applied to the price for the buyout license.
